Terms of Service
These Terms of Service ("Terms") govern your access to and use of the SecureNest platform ("Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility & accounts
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your information, for keeping your credentials secure, and for all activity under your account. Notify us immediately of any unauthorised use.
2. Roles & responsibilities
- Landlords are responsible for the accuracy of their listings, charges, and the lawful management of their tenancies.
- Tenants are responsible for the accuracy of applications and for meeting their payment obligations.
- Agents act on behalf of landlords to the extent authorised and must comply with those arrangements.
SecureNest provides software to facilitate these relationships; it is not a party to any tenancy agreement between users, is not a landlord or letting agent, and does not provide legal, financial, or tax advice.
3. Identity verification
To reduce fraud, we may require identity verification (e.g. NIN/BVN). You authorise us and our verification partners to process this information for that purpose. We may limit access to certain features until verification is complete.
4. Payments, fees & payouts
Payments are processed by third-party providers (e.g. Paystack). By initiating a payment you authorise the applicable charge. Amounts (rent, agency and agreement fees, utilities, service charges, commissions) are computed by the platform based on the configuration set by the relevant landlord.
For landlords on the free plan (or whose paid plan has lapsed), tenant payments may be collected by the platform and settled to the landlord via the payout queue, subject to a platform service fee (currently 1%). Landlords on an active paid plan who have connected their own payment account may receive payments directly. Refunds, where applicable, are handled through the original payment method.
5. Subscriptions & renewals
Paid packages are billed per their billing cycle. Subscriptions include a grace period after expiry during which paid features continue; if not renewed, the account steps down to the free plan and platform-collection terms apply. If you enable auto-renew, you authorise us to charge your saved payment method at renewal; you can disable auto-renew at any time before the renewal date. Fees already paid are non-refundable except where required by law.
6. Acceptable use
You agree not to: break the law; infringe others' rights; upload false, harmful, or unlawful content; attempt to bypass security or access data that is not yours; scrape or overload the Service; or use it to harass or defraud others.
7. Your content
You retain ownership of content you submit. You grant us a limited licence to host and process it to operate the Service. You are responsible for having the rights to any content you upload.
8. Tenancy disputes
Disputes between landlords, tenants, and agents are between those parties. SecureNest may provide records (e.g. payment history, signed leases) to assist, but is not responsible for resolving such disputes.
9. Availability & changes
We aim for high availability but do not guarantee uninterrupted service. We may add, change, or remove features, and may update these Terms; material changes will be notified through the platform or by email.
10. Disclaimers & liability
The Service is provided "as is" without warranties of any kind to the maximum extent permitted by law. To the fullest extent permitted by law, SecureNest is not liable for indirect, incidental, or consequential damages, or for amounts exceeding the fees you paid to us in the 12 months preceding the claim.
11. Suspension & termination
We may suspend or terminate accounts that violate these Terms or pose a security or legal risk. You may stop using the Service at any time; certain records may be retained as described in our Privacy Policy.
12. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws rules, and the courts of Nigeria have jurisdiction, unless otherwise required by applicable mandatory law.
